TERMS AND CONDITIONS
These Terms and Conitions are between
Perfect Data Computers and the Buyer.
It is a condition of the Terms and Conditions
that these Terms and Conitions regarding the sale of products
and services by Perfect Data Computers to the Buyer be accepted
by the Buyer.
1.
Sale of Products
The buyer acknowledges and agrees that, once
a buyer has accepted a quote for a product from the Website,
email or phone, Perfect Data will sell to the Buyer the goods
which were requested by the Buyer and quoted upon by Perfect
Data in accordance with these Terms and Conditions.
2.
Prices
All prices include GST except otherwise specified.
All prices are subject to change without prior notice.
3.
Risk and Title
The risk in any products or services supplied
by Perfect Data to the Buyer passes to the Buyer upon delivery
of those products to the Buyer or the Buyer's agent. Title
to any products or services sold by Perfect Data to the Buyer
passes to the Buyer only once payment in full has been made
by the Buyer to Perfect Data.
4.
Trade Practices Act Provisions
The liability of Perfect Data for a breach of
condition or warranty contained or implied into these Terms
and Conditions is limited to:
• in case of goods, any one or more of
the following:

the replacement of the goods or the supply
of equivalent goods;

the repair of the goods;
• or in the case of services:
-
the supplying of the services again;
-
or the payment of the cost of having the
services supplied again.
5.
Warranty and Returns
12 months warranty is provided on products unless
specified. Warranty will not cover any item that has been
mishandled, modified, returned in inadequate packing and/or
interfered with by unauthorized personnel. Return of goods
can only be accepted within 7 days of purchase and when goods
are returned in original condition and packaging. Buyers will
be responsible for the cost of returning products or parts
to Perfect Data for warranty or credit.
6.
Modifications to Terms and Conditions
Perfect Data reserves the right to change these
Terms and Conditions if required, at its sole discretion.
Such changes will be posted on the Website and price list.
7.
Governing Law
The Buyer and Perfect Data agree that these
Terms and Conditions are governed by and must be construed
and enforced in accordance with the laws of NSW. The Buyer
and Perfect Data will irrevocably submit to the non-exclusive
jurisdiction of the courts of NSW.
Glossary
"Perfect Data or Perfect Data Computers"
means Romdon Pty. Ltd. T/A Perfect Data Computers ABN 64 004
015 552.
"Buyer" means the person who purchases
products or services from Perfect Data via Internet, Mail,
Phone or walk in customers.
"Quote" has the meaning given to the
term "quote" when used in the Buyer Terms and Conditions.
"Services" means the online trading exchange
and associated services provided by PERFECT DATA through the
Website.
" Website" means http//www.perfectdata.com.au.
